Olam Funding LLC is a direct provider of merchant cash advances ("MCAs") and working capital solutions to eligible businesses. A merchant cash advance is not a loan. It is a commercial transaction in which Olam Funding purchases a specified amount of your future receivables in exchange for an upfront cash payment. The repayment is not based on an interest rate; it is governed by the factor rate and terms set forth in your individual funding agreement.
Nothing on this Site constitutes an offer, commitment, or guarantee of funding. All transactions are subject to credit approval, underwriting review, and execution of a formal written agreement.

Olam Funding reserves the right to decline any application, withdraw any pre-approval, or modify any offer at any time prior to the execution of a final funding agreement, for any reason or no reason, in its sole discretion. Pre-qualification estimates, calculator outputs, and offer discussions are not binding commitments.
Merchant cash advances are commercial transactions and are not loans. An MCA is the purchase of future receivables and is not subject to state usury laws or lending regulations that apply to traditional loans. The factor rate applied to an MCA is not an annual percentage rate (APR). Any comparison of MCA costs to traditional loan interest rates should be performed with the assistance of a qualified financial advisor.

You acknowledge that electronic signatures on funding agreements and related documents are legally binding to the same extent as handwritten signatures under applicable law, including the Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law.
By providing a telephone number to Olam Funding LLC, you expressly consent to receiving servicing, collection, and other calls and messages, including auto-dialed and pre-recorded message calls and SMS/text messages, from us, our affiliates, marketing partners, and agents at any telephone numbers you have provided or may provide in the future, including any cellular telephone numbers. Your cellular or mobile telephone provider will charge you according to the type of plan you carry.
Our application process may involve third-party services including, but not limited to, Plaid Inc. for bank account verification and DocuSign for electronic signature. Your use of those services is governed by their respective terms and privacy policies. Olam Funding LLC is not responsible for the practices or content of any third-party service.
THE SITE AND ALL CONTENT, TOOLS, AND INFORMATION AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. OLAM FUNDING LLC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OLAM FUNDING LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Olam Funding LLC and its members, officers, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, your submission of false or fraudulent information, or your violation of any applicable law.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising under or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in such courts.
You agree that any cause of action arising out of or related to Olam Funding LLC, the Site, or any Site content must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
Our Privacy Policy is incorporated into, subject to, and made a part of these Terms. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Site after any modification constitutes your acceptance of the revised Terms.
These Terms, together with our Privacy Policy and any executed funding agreement, constitute the entire agreement between you and Olam Funding LLC with respect to the subject matter hereof and supersede all prior agreements, understandings, and communications.
