These SMS Terms & Conditions ("SMS Terms") describe the terms on which Olam Funding LLC ("Olam Funding," "we," "us," or "our") sends text messages to you and on which you agree to receive them. By opting in to receive SMS messages from Olam Funding through any of our website forms or by any other method described below, you agree to these SMS Terms, our Privacy Policy, and our Terms of Service.
Olam Funding's SMS program is a customer-care messaging program for applicants, merchants, ISO partners, and prospective customers who have provided their mobile number through one of our public web forms and have affirmatively opted in to receive text messages from us. The program is operated by Olam Funding directly and is administered through our messaging service provider.
Messages you receive from Olam Funding through this program include:
Olam Funding does not use SMS for unsolicited marketing or promotional messaging.
You opt in to receive SMS by checking the SMS-consent checkbox and submitting one of our public web forms at olamfunding.com/apply, olamfunding.com/iso-signup, or olamfunding.com/contact. The SMS-consent checkbox is unchecked by default and is separate from the checkbox by which you authorize Olam Funding to process your application. Consent to receive SMS is not a condition of submitting an application, of any purchase, or of receiving funding.
You may also opt in by replying to a message we have sent you (for example, replying YES, START, or SUBSCRIBE), by sending a text to one of our published business numbers initiating a conversation, or by another method we make available from time to time.
Message frequency varies. The number of messages you receive depends on the status and activity of your application or account, the volume of documents required for underwriting, and how actively you communicate with us. During active underwriting or active servicing of a funded transaction, frequency may be higher; outside of those periods it may be lower or zero.
Standard message and data rates may apply to each message sent or received, depending on your wireless plan and carrier. Olam Funding is not responsible for any carrier charges. Check with your carrier for details about your plan.
You can opt out of the SMS program at any time. To unsubscribe, reply STOP, END, QUIT, UNSUBSCRIBE, or CANCEL to any message we send you. After you send the SMS message STOP to us, we will send you a one-time confirmation message indicating that you have been unsubscribed. After that confirmation, you will no longer receive SMS messages from us through this program. To rejoin, opt in again using one of the methods described in Section 3.
Note: opting out of SMS does not opt you out of other Olam Funding communications (such as email or phone), and it does not terminate any underlying agreement you have signed with Olam Funding. To terminate an underlying agreement, you must follow the termination provisions of that agreement.

The program is generally available on major U.S. mobile carriers, including AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost, MetroPCS, Cricket, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages. Carrier participation is subject to change without notice.
Information you provide in connection with the SMS program is handled in accordance with our Privacy Policy. Mobile opt-in information and SMS consent will not be shared, sold, rented, or disclosed to any third parties or affiliates for marketing or promotional purposes. SMS opt-in data is not shared with third parties under any circumstances. The content of SMS conversations may be processed by our messaging service provider solely for purposes of operating, securing, and supporting the SMS program on our behalf, subject to confidentiality and data-protection obligations.
The following are examples of messages you may receive. Each transactional message you receive from Olam Funding will include the brand name "Olam Funding" and, where appropriate, opt-out and help language.
You must be at least eighteen (18) years old and the authorized user or account holder of the mobile number you provide. By opting in, you represent that you meet these requirements and that you have the authority to receive SMS messages at the mobile number you provided. You must promptly notify us if you change or relinquish your mobile number.
You are responsible for maintaining accurate contact information with us, for the security of any device that receives messages from us, and for the actions of any person to whom you give access to that device. If your mobile number changes or is reassigned, you must contact us promptly so that we can update or remove your number from the program.
The SMS program is provided "as is" and "as available." To the fullest extent permitted by law, Olam Funding disclaims all warranties relating to the program, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, uninterrupted operation, and security. Olam Funding is not responsible for the timeliness, delivery, or non-delivery of any message, for any error or omission in any message, or for any loss or damage arising from your use of, or inability to use, the program. To the fullest extent permitted by law, Olam Funding's aggregate liability arising out of or relating to the SMS program will not exceed one hundred U.S. dollars ($100).
We may update these SMS Terms from time to time. The "Last updated" date at the top of this page indicates when the SMS Terms were last revised. Material changes will be highlighted on the website, sent by SMS, or otherwise communicated. Your continued participation in the program after the effective date of any change constitutes your acceptance of the revised SMS Terms.
These SMS Terms and any dispute arising out of or relating to them are governed by the laws of the State of New York, without regard to conflict-of-laws principles. The exclusive venue for any action arising out of or relating to these SMS Terms is in the state or federal courts located in Kings County, New York.
